Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Pineapple platform, operated by Pineapple ("we," "our," or "us"). By creating an account or using Pineapple, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use Pineapple. If you are under 18, you must have permission from a parent or guardian. By using our platform, you represent that you meet these requirements.

2. Your Account

You are responsible for maintaining the security of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Marketplace Rules

For buyers

• You may purchase Agents for personal or commercial use as permitted by the Agent's license.
• Purchased Agents may not be redistributed, resold, or shared without the Maker's explicit permission.
• Refunds are available within 7 days of purchase if the Agent does not work as described.

For makers

• You must own or have rights to all content you publish on Pineapple.
• Agents must accurately represent their capabilities and limitations.
• You must disclose when outputs are AI-generated where required by law or platform policy.
• Pineapple retains a 20% platform fee on all transactions.
• Payouts are processed via Stripe to your connected bank account.

4. Prohibited Content

You may not publish, distribute, or use Agents that:

• Violate any applicable law or regulation
• Infringe on intellectual property rights
• Generate deceptive, misleading, or fraudulent content
• Produce sexually explicit, harassing, or hateful content
• Facilitate illegal activities or harm to others
• Collect personal data without disclosure and consent

5. Intellectual Property

Makers retain ownership of their Agents and content. By publishing on Pineapple, Makers grant us a non-exclusive license to display, distribute, and promote their Agents on the platform. Buyers receive a personal, non-transferable license to use purchased Agents as described.

The Pineapple name, logo, and platform design are our intellectual property and may not be used without permission.

5a. Copyright Complaints & Takedown Notices (DMCA)

Pineapple respects the intellectual property rights of others and expects Makers to do the same. If you believe content on Pineapple infringes your copyright, send a written notice to our designated agent that includes:

• A physical or electronic signature of the copyright owner or their authorized representative
• Identification of the copyrighted work claimed to have been infringed
• Identification of the material you claim is infringing, with enough detail for us to locate it on Pineapple
• Your contact information (address, phone number, and email)
• A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law
• A statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on the copyright owner's behalf

Send notices to our designated DMCA agent at pineapple.admin.support@gmail.com. Upon receiving a valid notice, we will remove or disable access to the reported material and notify the Maker who posted it. A Maker who believes their content was removed in error may submit a counter-notice with equivalent identifying information and a statement under penalty of perjury that the material was removed by mistake or misidentification; we will forward valid counter-notices to the original complainant and may restore the content per the process required by 17 U.S.C. § 512(g) unless the complainant files a court action. Pineapple terminates the accounts of Makers found to be repeat infringers.

6. Disclaimers

Pineapple is a marketplace platform. We do not create the Agents listed and are not responsible for their outputs. Agents are provided "as is" by their Makers. We review Agents before listing but cannot guarantee results, accuracy, or fitness for any particular purpose.

7. Limitation of Liability

To the maximum extent permitted by law, Pineapple shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the platform.

8. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice on the platform. Continued use after changes constitutes acceptance of the updated Terms.

9. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

9a. Dispute Resolution & Arbitration Agreement

Please read this section carefully — it affects your legal rights, including your right to file a lawsuit in court.

You and Pineapple agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of Pineapple will be resolved by binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. This agreement is governed by the Federal Arbitration Act.

The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and will be conducted by a single arbitrator. Arbitration will take place in the United States, or may be conducted by phone, video, or based on written submissions, at the option of the party seeking relief. The arbitrator's decision will be final and binding, subject only to very limited review under the Federal Arbitration Act.

Class action waiver: You and Pineapple agree that any arbitration or claim will be conducted only on an individual basis and not as a class, consolidated, or representative action. Neither you nor Pineapple may bring a claim as a plaintiff or class member in any purported class, collective, or representative proceeding.

Opt-out: You may opt out of this arbitration agreement within 30 days of first agreeing to these Terms by emailing pineapple.admin.support@gmail.com with your name, account email, and a clear statement that you wish to opt out of arbitration. If you opt out, disputes will be resolved in the state or federal courts located in the United States, and both parties consent to personal jurisdiction there.
